1. Agreement

These Terms of Service ("Terms") govern your access to and use of the public website operated by the Black Point group at blackpoint.digital (the "Site"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. Other agreements

If you enter into a separate written agreement with us (for example, for consulting, development, or other services), those contract terms control for that engagement. These Terms apply only to use of the Site and related marketing interactions unless expressly stated otherwise.

3. Acceptable use

You agree not to:

• Use the Site in any way that violates applicable law or infringes third-party rights;
• Attempt to gain unauthorized access to our systems, accounts, or data;
• Interfere with or disrupt the Site or servers (including introducing malware or excessive automated traffic);
• Scrape or harvest data from the Site in a manner that burdens our infrastructure or circumvents technical limits;
• Misrepresent your affiliation with Black Point or use our branding in a misleading way.

We may suspend or terminate access where we reasonably believe these rules are violated.

4. Intellectual property

The Site and its content (including text, graphics, logos, layout, and software) are owned by Black Point or its licensors and are protected by intellectual property laws. You may view and print reasonable portions for personal, non-commercial reference. You may not copy, modify, distribute, sell, or create derivative works from the Site or our trademarks without prior written permission, except as allowed by law.

5. Informational content

Materials on the Site are provided for general information and marketing. They do not constitute legal, tax, medical, or other professional advice. AI, technology, and business topics evolve quickly; we do not warrant that any description on the Site is complete or current for your situation.

6. Third-party services

The Site may link to or embed third-party services (for example, scheduling, messaging, or social networks). Those services are governed by their own terms and privacy policies. We are not responsible for third-party content or practices.

7. Disclaimer of warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLACK POINT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SITE (OTHER THAN LIABILITY THAT CANNOT BE LIMITED BY LAW) SHALL NOT EXCEED ONE HUNDRED EUROS (EUR 100) OR THE AMOUNT YOU PAID US FOR SITE-RELATED SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

9. Indemnity

You will defend, indemnify, and hold harmless Black Point and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms, except to the extent caused by our willful misconduct.

10. Governing law and disputes

For disputes relating solely to these Terms or your use of the Site (and not covered by a separate contract), the courts and laws of the Czech Republic apply, without regard to conflict-of-law rules that would require another jurisdiction's law. If mandatory consumer protections in your country give you rights that cannot be waived, those rights remain available to you.

For commercial engagements, the governing law and venue will be as set out in the agreement between you and the specific Black Point entity named in that agreement (which may be in Czechia or Poland).

11. Changes

We may modify these Terms at any time by posting an updated version on this page and changing the "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms.
